Regulation Amending the Regulation on Intermediary Activities and Supervision and Inspection of Intermediaries in the Turkey Product Exchange
Laws concerned: Capital Markets Law No. 6362
Published by the Ministry of Trade, this Regulation introduces several amendments to the Regulation on Brokerage Activities as well as the Surveillance and Supervision of Intermediaries in the Turkish Product Exchange. The new provisions expand the definition of the exchange to include futures contracts and allow intermediaries to trade ELÜS-based (Electronic Product Specialized Receipt) futures contracts on the exchange for their own account. Furthermore, exceptions have been introduced regarding the correction of erroneous transactions and the buying and selling of ELÜS by intermediaries for quantities below the minimum threshold.
The transition period concerning the authorization certificate process has been extended until 31 December 2028, and the procedures and exceptional cases to be complied with by intermediary institutions have been redefined. This regulation does not directly amend the Capital Markets Law No. 6362, but rather governs the procedures concerning brokerage activities and trading principles in the product exchange.
