Concordat expense advance tariff renewed and new amounts determined

Concordat Expense Advance Tariff

The Concordat Expense Advance Tariff, prepared by the Ministry of Justice, has entered into force upon publication in the Official Gazette. Based on the fourth paragraph of Article 285 of Enforcement and Bankruptcy Law No. 2004, this regulation sets the advance amounts to be deposited into the court treasury for concordat applications and outlines the implementation procedures. According to the tariff, applicants are required to pay items such as notification expenses, announcement fees, expert fees, five-month concordat commissioner fees, and bankruptcy expenses in advance.

For instance, the minimum announcement fee for the Turkish Trade Registry Gazette is set at TRY 2,600, along with the minimum wage amount for five months covering the provisional period for the concordat commissioner, and TRY 68,900 for bankruptcy expenses applicable to entities subject to bankruptcy. While the unused portion of the advance will be refunded after the finalization of the judgment, if it proves insufficient, the provisions of the Code of Civil Procedure will apply to request the completion of the missing amount. This new tariff entered into force on the date of its publication, repealing the previous tariff as of the same date.
